Terms of Service

Terms governing the use of aftermidnight.enterprises and what a submission to us does and does not create. Last updated 19 August 2026.

1. Who these terms are with

This website is operated by After Midnight Enterprises ApS, a Anpartsselskab (ApS) — Danish private limited company, CVR 38764845, EU VAT DK38764845, registered in Denmark on 01.07.2017, registered office Søndergade 44, 4., 8000 Aarhus C, Denmark. Contact: info@aftermidnight.enterprises, +45 71 86 64 95.

2. What this site is

It describes our publishing services and provides two ways to contact us. It sells nothing: there is no checkout, no subscription, no account and no payment page. Information here is provided in good faith and for general information; it is not advice, and it does not form part of any contract unless it is repeated in a signed agreement.

3. Sending a pitch

Sending a pitch does not create a publishing agreement and costs nothing. We charge developers no reading fee, evaluation fee or submission fee, and any deal is set out in a signed contract.

You keep every right in what you send us. We ask for links rather than attachments precisely so that you keep control of the material and can revoke access. We do not acquire a licence to your game, your assets or your documents by reading them, and we do not use submissions to develop competing work. Please do not send confidential third-party material, and do not send anything you are not free to share.

Ideas are not protected by confidentiality alone. Similar games exist, and we may already be working on something adjacent — a rejection is not evidence of anything else.

4. Financing and co-production

Development financing here means a commercial publishing agreement: where we agree to fund milestones, the money is advanced against the title and recouped from its revenue on terms set out in a signed contract. It is not a loan, deposit, security, investment product, crowdfunding offer or public offering, we take no money from developers, and we give no financial or investment advice.

We publish no funding capacity, no budget ceiling and no per-title figure. What can be financed depends on the project and on the agreement, and a number stated outside a signed contract would be a promise nobody could hold us to.

Nothing on this site is an offer of finance, an invitation to invest, a solicitation of funds, or financial, investment, tax or legal advice. Terms exist only in a signed agreement between the parties.

5. What we do not promise

Publishing outcomes depend on the game, the market and the launch window. We do not promise sales, revenue, wishlists, chart positions, platform approval, store featuring or press coverage.

Console submissions and rating applications are prepared by us and filed through the developer’s own platform accounts under written authorisation. We hold no platform-holder or ratings-body accreditation of our own and do not act as an approved agent for any of them.

6. Age ratings and platform requirements

Age ratings are issued by the ratings boards and platform holders — PEGI, ESRB, USK, IARC and the store operators — never by a publisher. We prepare and file rating questionnaires; the rating itself is theirs to grant.

Ratings, certification outcomes and store approvals are issued by the bodies that own them, on their own timetable and against their own criteria. We prepare the paperwork and we know the checklists; the decision is never ours.

7. Trademarks and third-party names

Steam, PlayStation, Xbox, Nintendo Switch, App Store and Google Play are named to describe where a title can be distributed. They are trademarks of their owners, and naming them implies no endorsement, partnership or approval of this company.

8. Work we will not take on

We do not publish, distribute or market: gambling or real-money wagering products; adult or sexually explicit content; content promoting hate, violence against people, or illegal activity; products aimed at circumventing platform rules, digital rights management or anti-cheat systems; and anything requiring a financial-services, medical or pharmaceutical licence we do not hold. We also do not resell or broker second-hand game keys.

9. Acceptable use of this site

Do not attempt to break, overload, scrape at scale, or gain unauthorised access to this site or its API. The forms are rate limited, and abusive submissions are deleted. Automated submission tools are blocked and their submissions discarded.

10. Liability

This site is provided as it is. To the extent permitted by Danish law, we exclude liability for indirect or consequential loss arising from use of the site or reliance on its general information. Nothing in these terms limits liability that cannot lawfully be limited, and nothing here affects the mandatory rights of a consumer under Danish law.

11. Complaints and disputes

Write to info@aftermidnight.enterprises or to the registered office above. We aim to acknowledge a complaint within ten working days and to resolve it as quickly as the facts allow. These terms are governed by Danish law, and the courts of Denmark have jurisdiction. Since this site sells nothing to consumers, no consumer-purchase dispute can arise from it; a complaint about anything else starts with the address in this paragraph.

12. Privacy and cookies

How we handle personal data is set out in the privacy policy; browser storage is described in the cookie policy. Identity and register details are on the company identity page.

13. Changes

These terms may change; the date at the top changes with them. Continuing to use the site after a change means the current version applies.
